Refund & Return Policy
This Refund & Return Policy (“Policy”) governs the purchase of heavy machinery and related equipment, including but not limited to forklifts, excavators, loaders, and attachments (collectively, the “Products”) sold through the Merolexx website (“Company,” “we,” “us,” or “our”). By placing an order, you acknowledge and agree to the terms set out below.
1. General Policy
Due to the nature, value, and customization of heavy machinery, all sales are considered final unless otherwise stated in writing or required by applicable law. Refunds, returns, or exchanges are permitted only under the specific conditions outlined in this Policy.
2. Eligibility for Returns
A return request may be considered only if all of the following conditions are met:
The Product is defective, damaged during transit, or materially different from the specifications confirmed in the sales agreement or invoice.
The issue is reported to Merolexx in writing within 7 days of delivery.
The Product has not been used, altered, repaired, or modified after delivery, except where limited testing was required to identify a defect.
The Product is returned with all original documentation, manuals, accessories, and components.
Products returned without prior written authorization will not be accepted.
3. Non-Returnable & Non-Refundable Items
The following items are non-returnable and non-refundable, except where required by law:
Used, refurbished, or second-hand machinery (unless otherwise stated in writing)
Custom-built or special-order machinery
Equipment sold on an “as-is” or “where-is” basis
Spare parts, consumables, wear-and-tear items, and accessories
Machinery damaged due to misuse, negligence, improper operation, or lack of maintenance
4. Inspection Upon Delivery
Customers are responsible for inspecting the Product immediately upon delivery. Any visible damage, shortages, or discrepancies must be:
Clearly noted on the delivery receipt or bill of lading at the time of delivery, and
Reported to Merolexx within 24 hours, supported by photographs or videos.
Failure to comply with this requirement may result in the claim being denied.

Clear photos or videos showing the defect or damage
If approved, Merolexx will issue a Return Authorization (RA) and provide return instructions. Unauthorized returns will be refused.
6. Refunds
Once the returned Product is received, inspected, and approved:
Refunds will be issued to the original method of payment, or
At our discretion, a replacement, repair, or store credit may be offered instead of a refund.
Refund processing may take 14–30 business days, depending on the payment method and financial institution.
Note: Original shipping, handling, customs duties, taxes, inspection fees, and related costs are non-refundable unless the return is due to our error.
7. Return Shipping & Costs
Unless otherwise agreed in writing, the customer is responsible for all return-related costs, including:
Shipping and logistics
Insurance
Loading and unloading
Transportation fees
Returned machinery must be securely packed and insured for its full value. Merolexx is not responsible for damage occurring during return transportation.
8. Warranty Claims
Refunds are not provided for issues covered under a manufacturer’s or Merolexx warranty. Warranty claims will be handled strictly in accordance with the applicable warranty terms provided at the time of sale.
9. Order Cancellations
Orders may be canceled only before shipment and must be confirmed in writing.
Approved cancellations may be subject to administrative, restocking, or processing fees.
Orders that have already shipped or entered production cannot be canceled.
10. Limitation of Liability
To the maximum extent permitted by law, Merolexx’s liability is limited to the purchase price of the Product. We shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of profit, downtime, or project delays.
11. Governing Law
This Policy shall be governed by and construed in accordance with the laws of the Republic of South Africa, Northern Cape, without regard to conflict of law principles.
